3. Quotations & Pricing
Quotations provided are estimates based on information available at the time and remain valid for 30 days unless otherwise stated. Final pricing may vary depending on site conditions, material costs, and scope changes. All prices are in South African Rand (ZAR) and exclude VAT unless explicitly stated otherwise. Additional costs for travel, materials, or unforeseen work will be communicated and agreed upon in writing before proceeding.
4. Payment Terms
Payment terms will be specified in project agreements. Typically, a deposit is required to confirm booking, with final payment due upon project completion. Accepted payment methods include bank transfer, cash, and credit card (where applicable). Late payments may result in project suspension. All invoices are due within 30 days of issue unless alternate terms are negotiated.
5. Cancellation & Refunds
Cancellations must be made in writing. Refund eligibility depends on project stage: cancellations more than 14 days before work commencement may be eligible for a refund (minus any non-recoverable deposits); cancellations within 14 days forfeit the deposit; cancellations after work has begun are non-refundable. Weather delays are not grounds for cancellation or refund.
6. Warranties
Hart Home & Garden warrants that all work will be performed professionally and in accordance with industry standards. We make no warranty regarding plant survival, growth rates, or aesthetic outcomes, as these depend on ongoing client care and environmental factors beyond our control. Planting warranties (if offered) will be detailed in the project agreement and typically cover 30-90 days with proper client maintenance.
7. Limitation of Liability
To the fullest extent permitted by South African law, Hart Home & Garden shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit or data, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount paid by the client for the service in question. This limitation applies to all claims, whether based on warranty, contract, negligence, or any other legal theory.
8. Intellectual Property
All content on this website, including text, images, graphics, logos, and design plans, is the property of Hart Home & Garden or licensed to Hart Home & Garden and protected by copyright law. You may not reproduce, distribute, or transmit any content without written permission. Garden designs created for clients remain the intellectual property of Hart Home & Garden unless otherwise agreed in writing; clients receive a license to use the design on their property only.
